Terms of Service

1. Acceptance

By using FastPoll.io (“the Service”), you agree to these terms. If you don't agree, don't use the Service. The Service is operated by WorkflowPrecision LLC (“we”, “us”).

2. Accounts

2.1 Account creation

You can create polls without an account. To manage polls long-term, purchase credits, or access Pro features, you need an account. You can sign up with email/password or Google OAuth.

You must provide accurate information. One account per person. You are responsible for your account credentials.

2.2 Account termination

You can delete your account at any time from Settings. We can suspend or terminate accounts that violate these terms, with or without notice depending on severity.

3. Polls

3.1 Creating polls

Anyone can create a poll with a valid Turnstile verification. Polls are public by default — anyone with the link can view and vote.

You are responsible for the content of your polls. This includes the question, options, and any uploaded images.

3.2 Poll lifecycle and automatic closure

Polls are automatically managed based on their type:

Unclaimed anonymous polls (created without an account):

• Auto-close 7 days after creation.
• A warning banner appears on the poll 2 days before closure.
• To prevent closure, create an account and claim your poll before the deadline.
• Claiming is free and immediate — a claim banner on the poll links directly to signup with auto-claim on redirect.

Claimed polls (owned by a free-tier account):

• Auto-close 30 days after the last vote is cast.
• A warning banner appears 2 days before closure.
• Any new vote resets the 30-day clock.
• You receive email warnings at 7 days and 1 day before deletion (see Section 3.3).

Pro polls (upgraded with 1 credit):

• Never auto-closed. Active indefinitely.
• Never auto-deleted. Data retained as long as the poll exists.

Polls with a manual end date:

• Close automatically when the creator-specified end date passes.
• The end date is visible to voters on the poll page.
• Standard archive and deletion timelines apply after closure.

3.3 Archive, deletion, and email warnings

When a poll closes (by any mechanism), the following timeline applies:

Anonymous polls do not receive email warnings (no email address on file).

Pro archived polls are never permanently deleted and can be restored by contacting support.

3.4 Poll settings lock

Certain settings (e.g., single vs. multiple selection) are locked after the first vote is cast. This protects vote integrity.

4. Voting

4.1 One vote per person

We use device fingerprinting to enforce one vote per person per poll. Attempting to circumvent this (clearing fingerprints, using automation, etc.) is a violation of these terms.

4.2 Vote permanence

Votes cannot be changed or retracted once cast.

4.3 Voter contact collection

Some Pro polls collect an email address or phone number from voters before they can vote. This is contact collection, not identity verification — we do not send confirmation codes or verify ownership.

By entering your contact information and submitting your vote, you voluntarily agree to share that information with the poll creator. The poll creator controls what they do with it. We act only as a processor facilitating the collection.

If you're not comfortable sharing your contact information with the poll creator, don't vote on that poll.

5. Credits and payments

5.1 Credit system

Credits are the currency for upgrading polls to Pro. Credits are purchased via Stripe.

Bonus credits: 1 credit on first visit (fingerprint-based, one-time), +2 credits on account creation.

5.2 Upgrading polls

Upgrading a poll to Pro costs 1 credit. This unlocks all Pro features for that poll permanently (for the lifetime of the poll) and exempts the poll from automatic closure and deletion.

5.3 Refund policy

Credits are non-refundable once used (spent on upgrading a poll).

Unused credits are refundable within 14 days of purchase. To request a refund, email support@fastpoll.io with your account email and transaction details.

We do not offer refunds for bonus credits (landing bonus, signup bonus).

5.4 Credit expiration

Purchased credits do not expire as long as your account is active. If your account is deleted, unused credits are forfeited.

6. AI features

6.1 AI helper

The AI helper uses OpenAI to generate poll questions and options from your prompt. You are responsible for reviewing and editing AI-generated content before publishing. We are not responsible for AI-generated content that is inaccurate, biased, or inappropriate.

AI helper is rate-limited (10 generations per user per hour) and may be unavailable at times.

6.2 AI insights (Pro feature)

AI insights generates an automated summary and analysis of your poll results using OpenAI. To produce insights, we send your poll question, option texts, and vote counts to OpenAI. We do not send individual voter data, contact information, or any personally identifiable information.

AI insights are provided as-is. They are automated interpretations, not professional analysis. Do not rely on them for critical decisions without independent review.

7. Prohibited content and conduct

You may not use FastPoll.io to:

• Post content that is illegal in your jurisdiction or ours.
• Harass, threaten, or target individuals or groups.
• Post hate speech, incitement to violence, or content promoting self-harm.
• Distribute spam, phishing, or malware links.
• Collect personal data from voters under false pretenses or misrepresent how it will be used.
• Impersonate another person or entity.
• Create polls designed to manipulate elections or public decision-making through deception.
• Circumvent vote integrity measures (fingerprinting, rate limits).
• Use automated tools to mass-create polls, cast votes, or scrape data.
• Upload images you don't have the right to use.
• Use voter contact data collected through polls for unsolicited bulk messaging or sell it to third parties.

8. Content moderation

8.1 Reporting

Any user can report a poll for: Spam, Harassment, Hate Speech, Misinformation, Illegal Content, or Other. One report per person per poll.

8.2 Auto-hide

A poll is automatically hidden from public view after receiving 5 or more unique reports, pending manual review.

8.3 Our rights

We can remove any poll or content that violates these terms. We can do this without prior notice. Repeat violators will have their accounts terminated.

We are not obligated to monitor all content proactively, but we reserve the right to do so.

9. Intellectual property

9.1 Your content

You retain ownership of the content you create (poll questions, options, images you upload). By posting it on FastPoll.io, you grant us a non-exclusive, worldwide license to host, display, and distribute that content as part of operating the Service (i.e., showing your poll to voters).

This license ends when you delete the poll or your account, or when the poll is permanently deleted through the automatic lifecycle described in Section 3.3.

9.2 Our service

FastPoll.io, its design, code, and branding are our property. You may not copy, modify, or redistribute any part of the Service.

9.3 White-labeling

Pro polls can remove “Powered by FastPoll.io” branding and add a custom logo. This does not transfer any ownership of the underlying Service.

10. Availability and liability

10.1 No guarantees

The Service is provided “as is.” We aim for high availability but do not guarantee uninterrupted service. Firebase, Vercel, and Postmark outages are outside our control.

10.2 Limitation of liability

To the maximum extent permitted by law, we are not liable for:

• Loss of data, votes, or poll results, including through automatic deletion.
• Failure to deliver deletion warning emails.
• Decisions made based on poll results or AI insights.
• Actions taken by poll creators with voter contact data collected through polls.
• Inaccurate, biased, or inappropriate AI-generated content.
• Any indirect, incidental, or consequential damages.

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10.3 Indemnification

You agree to indemnify us against claims arising from your content, your use of the Service, your use of voter contact data, or your violation of these terms.

11. Governing law

These terms are governed by the laws of the State of Delaware, United States. Disputes will be resolved in the courts of the State of Delaware, United States.

12. Changes to these terms

We may update these terms. If changes are material, we'll notify logged-in users by email at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance.
